Background
On November 1, 1999 approximately 12:30 a.m., Youncy Toliver, Leon Young and two other young men were sitting at a red light, in Northeast San Antonio, TX when the Ford Escort they were driving was struck in the rear by David Rodriguez. Rodriguez, driving on a suspended license, had borrowed the 1982 Grand Prix from a friend and had consumed approximately 22 to 23 beers that day before the accident. Officials estimate Rodriguez was traveling approximately 65 miles per hour (25 mph over the speed limit) when he struck the small car. The impact of the collision broke the neck of Leon Young killing him instantly and the injuries to Youncy Toliver were so server that he was air lifted to University Hospital in critical condition. David Rodriguez's blood alcohol level was .29 (over 3 times the legal limit) a full two hours after the crash. He made no attempt to avoid the crash. He just plowed into the stopped vehicle in front of him, leaving no skid marks. According to police video, Rodriguez had no idea he had been in a crash. He thought the police were arresting him for failing to pay his child support, once again. It took him almost 3 days to recall anything about the crash. Rodriguez was sentenced to 15 years for intoxication manslaughter and 10 years for intoxication assault to be served concurrently.

Dear Board Members:

Please DO NOT grant parole to David Rodriguez. As a concerned citizen, I am writing to protest the projected parole. On 1 November 1999 Rodriguez, while driving intoxicated, collided with the rear of the car occupied by Youncy Toliver, Leon Young and two others as they waited at a red light in Northeast San Antonio. The force of the impact broke the neck of Leon Young, killing him instantly, Youncy Toliever was air lifted to a area trauma center in critical condition. Rodriguez, who was driving with a suspended license, is estimated to have been traveling 65 mph when he struck the stopped car. Evidence at the scene indicated that Rodriguez had made no attempt to stop before the 1982 Grand Prix he was driving impacted the stopped vehicle. Rodriguez's blood alcohol level was .29 (over 3 times the legal limit) a full two hours after the crash.

Justice demands that Rodriguez be made to serve his complete sentence. In addition, to lessen the trauma for the victims families, please consider a five year set-off before future parole reviews.
